Wisconsin Republicans Cement Their Subversion of Democracy

Washington, D.C. – This afternoon, outgoing Wisconsin Governor Scott Walker signed legislation preventing the duly elected incoming Democratic Governor and Attorney General from withdrawing from the deeply unpopular Walker-Schimel-Trump assault on the Affordable Care Act and pre-existing conditions in federal court. In response, Brad Woodhouse, executive director of Protect Our Care, released the following statement:

“Scott Walker and Wisconsin Republicans don’t care about protecting their constituents’ health care, the rule of law, or the will of the people. After being trounced at the polls precisely because of their of their anti-health care agenda, despite their last ditch false promises to protect people with pre-existing conditions, they went ahead and rammed through legislation designed to take away Wisconsinites’ coverage while refusing to pass legislation to protect those individuals with pre-existing conditions. 2.4 million Wisconsinites could lose their health insurance and Scott Walker and his band of phony cronies could not care less. This is far from over.”

THE AFFORDABLE CARE ACT OUTLAWED DISCRIMINATION BASED ON PRE-EXISTING CONDITIONS – GOP LAWSUIT TO OVERTURN THE LAW BRINGS DISCRIMINATION AGAINST PRE-EXISTING CONDITIONS BACK

Because Of The Affordable Care Act, Insurance Companies Can No Longer Deny Coverage Or Charge More Because Of Pre-Existing Conditions. Under current law, health insurance companies can’t refuse to cover you or charge you more just because you have a ‘pre-existing condition’ — that is, a health problem you had before the date that new health coverage starts.” [HHS]

The ACA Outlawed Medical Underwriting, The Practice That Let Insurance Companies Charge Sick People And Women More. As the Brookings Institution summarizes, “The ACA outlawed medical underwriting, which had enabled insurance carriers to court the healthiest customers while denying coverage to people likely to need costly care. The ACA guaranteed that all applicants could buy insurance and that their premiums would not be adjusted for gender or personal characteristics other than age and smoking.”

The ACA Stopped Companies From Charging Women More Than Men For The Same Plan. The Affordable Care Act eliminated “gender rating,” meaning American women no longer have to pay an aggregated $1 billion more per year than men for the same coverage.

Thanks To The Affordable Care Act, Insurance Companies Can No Longer Rescind Coverage Because of Illness. Because of the ACA, insurance companies can no longer rescind or cancel someone’s coverage arbitrarily if they get sick.

HEALTH CARE WAS THE TOP ISSUE FOR WISCONSIN VOTERS

A Public Policy Polling election day survey of Wisconsin voters found that health care was the top issue for voters in the state — and that they overwhelmingly favored Democrats on it, propelling Tony Evers to victory.

  • 68% of voters said that health care was either a very important issue, or the most important issue to them. Those voters supported Evers over Scott Walker 65-33.
  • When asked to name the single issue most important to them in 2018, a plurality (27%) picked health care. Among those voters who said health care was their single most important issue in the election, Evers defeated Walker by a whopping 89-7 margin.
  • Evers especially had an advantage over Walker when it came to the issue of who voters trusted more to protect people with pre-existing conditions. 50% preferred Evers to protect pre-existing conditions to only 41% who preferred Walker.
  • Scott Walker’s support for the Republican health care repeal agenda hurt him badly. Only 32% of voters said his support for repeal made them more likely to vote for him, while 47% said it made them less likely to support him.

An overwhelming majority of Wisconsinites want to see the Affordable Care Act stay in place – 62% think it should be kept with fixes made to it as necessary, compared to only 32% of voters who support repealing it.

Seema Verma and Donald Trump Continue to Hide Behind Lies As Americans Continue to Worry About their Care

“Instead of a super secret so-called contingency plan which no one actually believes exists, just end the lawsuit,” said Brad Woodhouse.

Washington, D.C. – In response to CMS Administrator Seema Verma telling the Washington Examiner that the Trump Administration has a secret “contingency plan” should their lawsuit to upend the American health care system go through, Brad Woodhouse, executive director of Protect Our Care, released the following statement:

“The best contingency plan for protecting American health care – and especially for those with pre-existing conditions – is for the Administration to withdraw its support for this disastrous lawsuit and instead defend the law of the land. The American people have made their voices loud and clear: they support the Affordable Care Act, they want people with pre-existing medical conditions to be protected from discrimination by insurance companies, and they oppose any and all GOP efforts to undermine their health care. Instead of a super secret so-called contingency plan which no one actually believes exists, just end the lawsuit.”

 

THE CLAIM:

CMS Chief Seema Verma Claims That She And The Trump Administration Have A Contingency Plan If The Trump-GOP Lawsuit To End Protections For Pre-existing Conditions is successful [Washington Examiner]:

Seema Verma told reporters that “we do have contingency plans” if the healthcare law is struck down — specifically the provision aimed at ensuring people with pre-existing conditions, such as cancer or diabetes, have access to coverage.

But Chief Seema Verma declined to describe the backup plan, saying that “it wouldn’t be appropriate to share details because it may or may not be needed.”

 

THE REALITY:

If Judge Reed O’Connor rules in favor of the 20 Republican state officials and Trump’s Department of Justice, Seema Verma and Donald Trump will own the consequences to the American people. And those consequences are serious. Critical Affordable Care Act protections could vanish overnight, unleashing — as the Trump Administration itself admitted — “chaos” in our entire health care system.

  • 17 million people could lose their coverage in a single year, leading to a 50 percent increase in the uninsured rate
  • Protections for 130 million people with pre-existing conditions, their own, could end.
  • Medicaid expansion, currently covering 15 million Americans, could vanish.
  • Improvements to Medicare, including reduced costs for prescription drugs, would be eliminated.
  • Children would no longer be allowed to stay on their parents’ insurance until age 26
  • Ban on annual and lifetime limits? Gone.
  • Ban on insurance discrimination against women and people over age 50? Nope.

Fact-checking Mike Braun’s Two Big Health Care Lies Last Night

In his debate against Senator Joe Donnelly last night, Mike Braun doubled down on two big health care lies in an act of total political desperation because of the overwhelming unpopularity of his health care positions, including the junk insurance plan he offered his employees.

 

Last night, Braun Said, “I would never be for any replacement that doesn’t cover pre-existing conditions.”

 

BUT THE TRUTH IS BRAUN HAS PLEDGED TO “REPEAL AND REPLACE EVERY WORD” OF ACA, INCLUDING PROTECTIONS FOR PRE-EXISTING CONDITIONS

Braun, June 2018: I Will “Fully Repeal” Obamacare. “In the Senate, I will use my business experience and work with President Trump to fully repeal Obamacare and implement free-market solutions that will provide better healthcare for Hoosiers.” [City-County Observer, 7/26/18]

Washington, D.C. – Ahead of President Trump’s latest effort to hide the truth of the Republican war on health care, Leslie Dach, chair of Protect Our Care, released the following statement:

 

“Donald Trump’s speech fails the one in four Americans struggling to afford the prescription drugs they need. Today’s speech flouts  Trump’s campaign promise to let Medicare negotiate drug pricing for drugs sold in pharmacies, and it does nothing to change the fact that Trump and Republicans called for, voted to, and are now suing to repeal the requirements in current law that prescription drugs are covered in insurance plans.

 

“Between their efforts to repeal prescription drug coverage in Congress and the courts and their work to push junk plans that don’t cover prescription drugs, Trump’s posturing on drug prices is as outrageous as Trump’s professed care and concern for people with pre-existing conditions. Making this announcement 13 days before an election where health care is the number one issue to voters just goes to show the desperation of a president who has led a GOP war on health care and who promised prescription drug price cuts, while drug costs go up for Americans at the same time drug company profits  skyrocket.”

  • After Trump Promised Prescription Drug Price Cuts, Costs Went Way Up. In May, President Trump promised that prescription drug price cuts would be coming in “two weeks.” Months later, the Financial Times reported that several drugmakers raised their prices significantly, including double-digit increases in many cases, and an analysis by the Associated Press found “there were 395 price increases and 24 decreases” in the wake of the announcement and “the two dozen cuts were up from the 15 decreases in those same two months last year.”

 

 

  • Drug Prices Continue To Soar Under Trump. From January 1 to July 31 of this year, the Associated Press found there were 96 price hikes for every price cut this year. A recent report by Senate Democrats finds that the prices of the 20 most-prescribed drugs under Medicare Part D have increased substantially over the past five years, rising 10 times faster than inflation. Another report from the Pharmacy Benefits Consultants finds that over the past 14 months, 20 prescription drugs saw list-price increases of more than 200 percent.

 

 

  • Trump’s Previous Announcement Was Described As A “Big Win” For Big Pharma. In May, President Trump gave a speech billed as a major policy initiative to lower prescription drug costs. The phony speech was described as everything from a “big win” for pharmaceutical companies to him “[backing] out of his own plan to make drugs cheaper.” Said one drug lobbyist: “A lot of this [stuff] is meaningless to satisfy Trump.”

 

 

 

  • Drug Companies Using Windfall From GOP Tax Scam To Pad Investors’ Pockets. In February, Axios reported that America’s largest pharmaceutical companies were using their windfall from the GOP tax scam to drive up their own stock prices to the tune of $50 billion, “a sum that towers over investments in employees or drug research and development.”

 

 

 

  • Trump Installed Big Pharma Executives In Key Administration Posts. President Trump installed a former Eli Lily executive, Alex Azar, as his secretary of Health and Human Services and his appointment of Scott Gottlieb at FDA was described as “music to pharma’s ears.” Other pharma lobbyists writing Trump’s health policy include senior adviser at FDA, Keagan Lenihan, who joined the administration after lobbying for the drug distribution giant McKesson, former Gilead lobbyist, Joe Grogan, who reviews health care regulations at the Office of Management and Budget, and Deputy Assistant to the President for Domestic Policy Lance Leggitt, who has lobbied for a variety of drug-industry clients.

 

 

Trump Administration Deals Devastating Blow to Pre-existing Conditions Coverage & Other Health Insurance Protections

Washington, DC – In response to a new federal policy issued today that waters down the guardrails that ensure health insurance plans sold in states that are seeking approvals of “1332 waivers” provide the full range of benefits and the cost-sharing protections in the Affordable Care Act, Leslie Dach, chair of Protect Our Care, issued the following statement:

“The hypocrisy of Republicans rolling back protections for pre-existing conditions at a time when their candidates are campaigning as defenders of health care is outrageous. This is yet another blatant example of their repeal and sabotage agenda, and proof of their ongoing war on America’s health care.”

 

ADDITIONAL BACKGROUND:

Kaiser Family Foundation’s Larry Levitt Calls The Rule Out Today An “End Run” Around the ACA. Here is what 1332 waivers without appropriate guardrail protections could mean for consumers:

  • Protections for people with pre-existing conditions would be essentially meaningless. The American Cancer Society Cancer Action Network said allowing states to waive essential health benefits “could render those protections meaningless” for people with pre-existing conditions.
  • It would be harder for people with pre-existing conditions to get affordable coverage. As Consumers Union stated, allowing states to waive essential health benefits would be “putting meaningful coverage out of reach for many Americans, especially those with chronic and pre-existing conditions.”
  • You could pay more for the same coverage. 1332 waivers allow states to adjust the amount of premium tax credits and cost-sharing consumers receive to help lower their costs. Without the guardrail to ensure coverage is just as affordable, many consumers could end up paying more for the same care.
  • Insurers would not have to cover essential benefits, like maternity care. Right now, every insurance plan must cover the 10 essential health benefits. Because states could opt out of covering these basic benefits, insurers would likely only offer policies that covered much less than they do now. The Kaiser Family Foundation found that the benefits most likely to no longer be covered would be maternity care, mental health or substance abuse coverage. According to the Brookings Institution, the result would be “that no one in a state’s individual market that waived EHBs would have access to comprehensive coverage. Insurers would likely sell separate policies for benefits not covered in their core plan offerings, but these supplemental policies would be subject to tremendous adverse selection, leading to very high premiums and enrollment almost exclusively by those with pre-existing conditions.” For example, a woman who purchases a separate insurance rider for maternity care would have to pay $17,320 more, according to the Center for American Progress. For states that no longer required substance use disorders or mental health to be covered, coverage for drug dependence treatment could cost an extra $20,450.
  • Insurers could reimpose lifetime and annual limits. Allowing states to opt out of the essential health benefits coverage means that insurance companies could once again put lifetime and annual limits on the amount of care you receive. Moreover, as the Center on Budget and Policy Priorities notes, this would even impact people with coverage from their employer: “The ACA’s prohibition on annual and lifetime limits is tied to the definition of Essential Health Benefits. Thus, repeal of Essential Health Benefit standards could make this protection meaningless, putting almost all Americans with private health insurance coverage — not just those with individual or small-group market coverage — at risk.” The Center for American Progress estimates that 20 million people with health coverage through their employer would face lifetime limits on coverage, and 27 million would face annual limits.

SHOT: During last night’s Senate debate, Senator Ted Cruz said, “On Obamacare, I want to repeal Obamacare, reduce premiums, protect pre-existing conditions, and expand access.”

 

CHASER: Ted Cruz — one of the Senate’s biggest cheerleaders for health care repeal — lied to Texans last night. From his repeated votes to repeal pre-existing conditions protections, to his vocal support for the Trump-GOP lawsuit to overturn protections for people with pre-existing conditions overnight, to leading the Republican effort to shut down the government over implementation of the Affordable Care Act — which guarantees protections for people with pre-existing conditions — to his votes to cut billions from Medicare and Medicaid, Ted Cruz has worked to rip away protections for people with pre-existing conditions every chance he’s gotten.

She Lied: Rep. Martha McSally Voted to Gut Protections for People with Pre-Existing Conditions

“McSally is the latest in a long line of Republicans telling shameful, outright lies out of desperation to conceal their votes to strip the pre-existing conditions protections millions of Americans depend upon,” said Brad Woodhouse, executive Director  of Protect Our Care.

 

SHOT: At last night’s Senate debate, Congresswoman Martha McSally stated, “I voted to protect people with pre-existing conditions.”

 

Chaser:  McSally lied to Arizonans last night. She voted to repeal the Affordable Care Act, including its protections for people with pre-existing conditions. In its place, she tried to pass “the American Health Care Act,” (AHCA) which would have gutted protections for pre-existing conditions and forced people to spend thousands more for the care they need: an estimated $4,270 extra for asthma, $17,060 extra for pregnancy, $26,180 extra for rheumatoid arthritis and $140,510 for metastatic cancer.

 

That’s not all: The nonpartisan Congressional Budget Office found that the ACHA would have raised premiums 20 percent in 2018 and the negative economic impact of the American Health Care Act would cause 60,714 Arizonans to lose their jobs by 2022.

 

NEW POLL: Health Care Is A Top Issue For Wisconsinites in Senate Race Helping Push Baldwin to 10 Point Lead over Vukmir, 52-42

Washington, DC – A new poll from Public Policy Polling (PPP) for Protect Our Care shows health care is a top issue for voters and that Wisconsinites trust health care champion Senator Tammy Baldwin and Democrats more with their health care than Leah Vukmir and Republicans. This poll comes on the heels of Senator Baldwin and Leah Vukmir’s second debate in Wausau, Wisconsin.  Brad Woodhouse, executive director of Protect Our Care, issued the following statement in response to the poll findings:

 

“For Leah Vukmir, the jig is up. Leah Vukmir’s extreme anti-health care positions have done absolutely nothing to help people with pre-existing conditions in Wisconsin — and worse, in fact, it’s hurt women, children and working families. That’s why Wisconsinites know she can’t be trusted on health care and why they prefer Senator Baldwin both on the issue of health care and in their voting preference this fall.”

 

Key Findings from the Protect Our Care-Public Policy Polling  survey of Wisconsin Voters:

  • Forty-seven percent of voters say health care is very important when deciding who to vote for in the US Senate election
  • Sixty-three percent of voters say want to keep what works and fix what doesn’t in the health care law
  • Forty-nine percent of voters have a major concern with Leah Vukmir’s opposition to Medicaid expansion
  • Fifty-three percent of voters oppose Republican efforts to repeal the Affordable Care Act
  • Fifty-three percent of voters trust Senator Tammy Baldwin more on the issue of health care
  • Sixty-three percent of voters oppose the Trump’s Administration’s lawsuit strike down the health care law’s protections for people with pre-existing conditions
  • In a head to head matchup, Senator Baldwin enjoys a commanding 10 point lead over Vukmir, 52-42.

Public Policy Polling surveyed 816 Wisconsin voters on October 10-11, 2018.  The margin of error for the poll is +/- 3.4%. This poll was conducted using automated telephone interviews on behalf of Protect Our Care.

Vukmir Supports “Obamacare’s Full Repeal.” “Vukmir reaffirmed her stance against Obamacare. Mattias Gugel, a Vukmir spokesman, said: ‘As a nurse, Leah wants to ensure all people have access to quality health care. Here in Wisconsin — that’s exactly what we had for people with pre-existing conditions before Obamacare was forced on us. Leah has long supported Obamacare’s full repeal and free-market solutions that cover people with pre-existing conditions.’” [Milwaukee Journal Sentinel, 6/9/18]

 

  • Just what are the “free-market solutions” that existed before the Affordable Care Act that Vukmir says she supports? Well, before the Affordable Care Act became law, health coverage on the nongroup market was described as the “wild wild West” of health insurance marketplaces. That was because consumers were at the mercy of insurance companies that could deny coverage, drop coverage, or charge people more based on their health status, gender and age. That was a time when a 60-year-old could be charged $3,854 more annually in premiums.

Vukmir Supported Scott Walker’s Plan To Convert All Health Care Programs To Block Grants: “A Successful Repeal Of Obamacare Begins With The Federal Government Handing Over The Reins To The States.” “State Sen. Leah Vukmir, R–Brookfield, Tuesday endorsed Gov. Scott Walker’s request of the White House and Congress to send states block grants, giving them full responsibility for health care programs. ‘Healthcare is very personal,’ said Vukmir, chairman of the Senate Health & Human Services Committee. ‘That’s why those closest to our constituents, not Washington bureaucrats, should be responsible for tailoring our programs to fit Wisconsin’s needs. A successful repeal of Obamacare begins with the federal government handing over the reins to the states.’” [State Senator Leah Vukmir Press Release, 8/22/17]

 

  • Converting health care programs to block grants was the core of what the Graham-Cassidy repeal bill would have done. Multiple independent analyses agreed that the Graham-Cassidy repeal bill would have cut federal funding to states including a $29 billion cut over two decades to Wisconsin.

 

Though Leah Vukmir claims she supports protections for people with pre-existing conditions, saying “patients with pre-existing conditions should be covered,” she has turned her back on Wisconsinites at every opportunity to do so.

 

  • Vukmir refuses to stand against a lawsuit designed to end protections for people with pre-existing conditions. This summer, the Trump Administration refused to defend against a lawsuit brought by twenty conservative states aimed at overturning the Affordable Care Act and its protections for people with pre-existing conditions. Leah Vukmir refuses to speak against this lawsuit, instead calling it a “necessary step.”

 

 

 

  • Vukmir refuses to take action at the state level against the Trump administration’s junk plan and association plan rules that let insurance companies discriminate against people with pre-existing conditions. This summer, the Trump Administration finalized a junk plan rule and an association plan rule that allow insurance companies to discriminate against people with pre-existing conditions. Experts warn that these moves will only increase the cost of comprehensive care, ultimately making it even harder for people with pre-existing conditions to get the care they need. Twenty-one states have taken or are taking action to limit the harmful effects of these junk plans, but Vukmir refuses to do the same for Wisconsin.

 

 

 

  • Vukmir supports Trump’s nominee to the Supreme Court, Brett Kavanaugh. As cases to overturn the Affordable Care Act make their way through the courts, Leah Vukmir still has not come out against Brett Kavanaugh, President Trump’s nominee to the court. Instead, she has voiced support for Trump’s nominee who could decide cases that would strip protections from people with pre-existing conditions. Kavanaugh has previously criticized Chief Justice Roberts’ decision to uphold the Affordable Care Act.

 

 

It’s Time to Come Clean: Blackburn Lies About Her Record On Pre-Existing Conditions During Senate Debate

Washington DC – In response to last night’s Senate debate between Marsha Blackburn and Phil Bredesen, Protect Our Care issued the following statement from Dr. Thomas Phelps:

“Representative Marsha Blackburn wants to have it both ways: she says she supports protections for Tennesseans with pre-existing conditions, but her voting record shows otherwise. Rep. Blackburn’s vote for the American Health Care Act (AHCA) last May was a vote to weaken protections for at least 2.7 million Tennesseans with pre-existing conditions, and no amount of backtracking she does now can make up for that.”

In fact, when Marsha Blackburn couldn’t even defend her own health care voting record, she turned to calling the ACA “HillaryCare” to distract from the real threat at hand – the gutting of protections for Tennesseans for pre-existing conditions.

What Did AHCA Mean For Pre-Existing Conditions?

  • The American Health Care Act weakens key protections of the Affordable Care Act by allowing states to let insurers charge people with pre-existing conditions more, among other provisions. The bill would also make it more likely insurers would cherrypick young and healthier people, causing costs to skyrocket for older, sicker people.

 

 

  • Politifact found that AHCA “would weaken protections” for those with pre-existing conditions and “would allow states to give insurers the power to charge people significantly more.”

 

Here We Go Again: Mike Braun Rewriting His Own History During Senate Debate

Washington, DC – Last night, Mike Braun continued his desperate attempt to convince Hoosiers that he would defend protections for people with pre-existing during his debate against Senator Joe Donnelly, a true leader who has worked tirelessly to protect health care for all Americans. Brad Woodhouse, executive director of Protect Our Care, issued the following statement in response to Bruan’s claims, which were called out by AP factcheckers during debate:

 

“Once again, Mike Braun isn’t being honest with the people of Indiana, who want their leaders to protect health care. Braun ought to get four-pinocchios everytime he mentions keeping protections for people with pre-existing conditions since he has consistently tried to gut protections for people with conditions like cancer, diabetes or heart disease.
